The Digital Age is the result of technological evolution and the advent of investment in innovation, which is progressing at an accelerated rate every day. The reference source for this technological growth is directly related to investment in innovation, especially in the area of Information and Communication Technology. As a result, factors of production such as the internet, telematics and information technology provide convenience and economic development, and open up obvious opportunities such as e-commerce, electronic mail, social networks, among others. At the same time, it allows for the emergence of opportunism based on the insecurity of the digital environment and the lack of knowledge of information and communication technology users about the resources used. These issues have given rise to questions such as the relevance of assets that are not yet protected by criminal law and the effective ways of bringing the threat to legally protected assets to the attention of the competent court, by evidential means, in the midst of cybercrime.
